		<description>IF YOU HAVE FULLY COMPREHENSIVE INSURANCE ,they will handle it for you on receipt of the statement of facts and the police report.You must always get the police to attend to safeguard your claim,sometimes the police will state that as there is no personal injury ,they will leave it to you,but you should take the number of the attending officer and put it in your insurance statement.If,as i suspect,you have agreed with the other driver,not to call the police,then its his word against your word,he could now say that you backed into his vehicle.However,as his insurance company has sent you that letter,it sounds as though he has done the honorable thing and told them the truth.They now require you to confirm this ,in writing,with a statement of facts so that they can facilitate your claim and repairs etc.If you have third party only insurance, all you have to do is just write it down as a story, in sequence,giving time ,date,location,sequence of events,did the police attend,if not,why not,and any other information that can help them.You will start the letter&gt;&gt;&gt;&gt;&gt;On such a time and date i was sat in my car  (index number ) stationary at the traffic lights on such a road at the junction with such a road,when a car approaching from behing ran into the rear of my vehicle,etc etc etc.Hope this helps,no worries,good luck.This letter must not be sent, if you have fully comp ins,as they will deal with it for you,but they will require the same statement of facts,you should always call the police to safeguaqrd yourself,you may even stop a drunk driver from hitting someone else.</description>

		<description>This may be a trick. They might be trying to trick you in saying something in the letter that they&#039;ll use against you. Ask your own insurance company for advice. MSAD&#039;s sample letter sounds good enough and that&#039;s why you should keep it simple.</description>

You may not need to write the letter if you have your own insurance company handle this for you.  Call them ASAP like you should have when this happened. But this is a futile excercise.  HIS insurance company has NO duty of good faith towards you.  If he WAS covered, and they were responsible to pay you, they&#039;d be paying you.

So, either he isn&#039;t an insured driver, or you&#039;re in a no pay no play state and aren&#039;t eligible to recover damages, OR, they&#039;re stalling for time hoping that the statute of limitations runs out before you get done jumping through all their hoops.

If you have no collision insurance, AND you&#039;re confident that legally you can collect from him, then file against the driver in small claims court.  That letter bit is NONSENSE.  It&#039;s not reasonable for them to be asking for that.</description>

		<description>I&#039;ve never heard of something like that. Usually the insurance company takes a recorded statement from you to get your side of the story. But if they need a letter to take a claim report...based on what you have posted....here&#039;s what I&#039;d do. 

I&#039;d get a copy of the police report showing that the police put the other driver at fault.  I&#039;d include a copy of the police report (keep one for yourself) and the letter would read:

Dear Sirs

Please find enclosed a copy of the police report for (date).  As the police determined (insert name of their driver) at fault for the accident, I am requesting reimbursement for may damages.  Please call me at (your phone number) so that we can discuss this matter further. 

Sincerely,

Your name. 

Keep a copy of the letter and the police report for yourself. You may want to write their insurance policy number on the letter if you know it. If you have an estimate for the damage to your car (from the shop you would have fix your car) you can enclose it ...but it&#039;s not required.  As far as the letter goes...I&#039;d just keep it simple.</description>
