Question by Ceekay: How do i write a letter of holding a person reliable for my car damages to send to his car insurance?
I was in a car accident, my car was hit from behind & now i need to claim for the damages from this guys insurance company. I have never been in a car accident before, his insurance company has asked me to forward a letter satting that i’m holding him reliable for the damages. I’m not sure how to write it. Can some one give me an example? would higly appreciate it :)

Write about the facts: the date of the accident, how did it happen, where, who is responsible, and who is to blame. Was the police present at the place of the accident? If it was, mention that too.

okay, if wondering. for example; My brother borrows my car, and wrecks it, and he is not listed as a driver in my car insurance, will my insaurance company(Statefarm) pay for the damages for my car?

yes they will and you still will be subject to the deductible. If your brother drives your car all the time I reccomend you putting him on your insurance, so your insurance company wont deny the claim.

Plus it will not go your on license it will go on the person who is driving the vehicle

In most states, the car insurance company can be sued only for the cost of the repair (of a car involved in a car accident) where they refused to pay on a claim. Thanks for your help.
I am in California so I am most interested in this question as it pertains to Calif.

I think to be awarded punitive damages you’d have to sue the manufacturer, and prove that they knew their product was unsafe.

My sister was borrowing my car, she was hit by someone who tried to avoid a pedestrian, she said the person did not want to exchange insurance information because all i have on the car is gap insurance, so they exchanged personal information instead. The car is totaled, and i was wondering which steps i should take from this point. Police officers were dispatched to the scene, but i was told there was no police report. Don’t officers have to fill out incident reports at the end of their shift?

if your sister is not found to be at fault, then the driver of the car who is at fault is responsible for paying all damages, through their insurance most likely, to their car or any others.

if your sister is found to be at fault, then your sister could be screwed.

I had an accident one month ago. Somebody hit the car behind me and got away, and pushed that car into my car. I have damages for $ 3600. Now the insurance company of the person who hit my car is not responsible for my damages. Is there anything I can do?
